Most of those explainers are written for legal teams. This one is written for operators: founders, engineering leads, and product managers who need to ship a compliant product without hiring a compliance department.

Here is what you actually need to show, and how to think about it practically.

Start here: what kind of AI system are you?

The EU AI Act uses risk tiers. Most lean SaaS products — unless they are making automated decisions about credit, employment, legal status, or critical infrastructure — sit in the minimal risk or general-purpose AI system tier. This does not mean zero requirements. It means the requirements are proportionate.

The practical question for most operators is not “how do I comply with the AI Act?” It is: “how do I show my buyers, auditors, and regulators that my AI usage is controlled?” Those are related but distinct questions.

What follows focuses on the second, because it is the one that causes deals to stall and audits to flag you.

What your buyers and auditors actually ask for

When a procurement team, security lead, or external auditor asks about your AI controls, they are usually asking six things:

GDPR and AI: the three things that get you flagged

GDPR has always applied to personal data processing. What has changed is enforcement appetite and regulator sophistication around AI-mediated flows.

1. Using personal data as model input without a legal basis

If users submit personal data through your product, and that data is forwarded to a third-party LLM (OpenAI, Anthropic, Mistral, etc.), you are processing personal data under Article 6. You need a legal basis. For most B2B SaaS, that basis is legitimate interest or contract performance — but you need to document it, and you need to demonstrate that you are not sending more data than necessary.

Practical control: A prompt inspection layer that detects personal data and applies configured handling (mask, tokenise, or block) before the prompt reaches the model. This is data minimisation in practice.

2. No documentation of what AI processes personal data

GDPR Article 22 restricts fully automated decisions that have significant effects on individuals. If your AI system makes or significantly influences decisions about people — pricing, eligibility, access — and there is no human review path, you have a compliance gap.

The EU AI Act: what lean operators actually need to do right now

The Act’s requirements are being phased in. For most lean SaaS operators in the minimal or limited risk tier, the immediate obligations are:

Transparency to users If your product uses AI in a way that affects users — especially in a conversational interface or automated output — you must make that clear. This is already required by GDPR principles; the AI Act makes it explicit.

Practical control: Clear product copy and terms that describe where AI is used and what data it processes.

Accuracy and robustness AI systems should produce accurate outputs. For high-stakes outputs, you should be able to demonstrate human oversight.

Practical control: Logging AI outputs, especially in consequential workflows. Human approval gates for actions that execute based on AI recommendations.

Data governance documentation You should be able to show how your AI systems were trained (if you fine-tune), what data they process, and how you manage quality and bias risk.

Practical control: If you are using foundation models (OpenAI, Anthropic, etc.) and not fine-tuning, your obligation here is primarily to document your usage, not to audit the underlying model. Your provider’s compliance documentation covers the model side.

The practical controls stack: what actually matters

1. Prompt inspection and data minimisation A layer that detects personal data, secrets, and regulated information in AI inputs and applies configured handling (mask, tokenise, block) before forwarding to the model. This is your data minimisation evidence.

5. Policy documentation A written, versioned document describing which AI providers your system uses, what data categories they may process, how you apply data minimisation, and what approval requirements apply to consequential actions. This is what you hand to a DPA, auditor, or procurement team.
