Professional services firms — law firms, management consultancies, accounting practices, advisory firms — are adopting AI faster than most of them are comfortable admitting. The productivity gains are real. So are the risks. And the risks in professional services are not the same as in other industries, because the data involved is almost always someone else’s.
Why professional services is a special case
Three characteristics make AI governance harder in professional services than in most other sectors.
Client confidentiality is contractual, not just regulatory. When a technology company’s employee pastes internal code into an AI tool, the risk is primarily to the company itself. When a lawyer pastes client documents into an AI tool, the risk is to the client — and the firm’s obligation to protect that data is contractual, fiduciary, and in many jurisdictions statutory. Using these tools for client work means client data is processed under consumer terms that provide no confidentiality protections.
The control: An approved tools list that specifies which AI tools are permitted for which use cases and data classifications. Browser-layer enforcement that warns or blocks when employees access unapproved AI tools.
4. Output attribution and accuracy
AI-generated content in client deliverables carries accuracy and attribution risks. A hallucinated case citation in a legal brief, an incorrect regulatory reference in a compliance memo, or a fabricated data point in a consulting framework creates professional liability exposure.
The control: This is primarily a workflow and review control, not a technical one. Firms need clear policies on where AI-generated content may and may not be used in client deliverables, and what human review is required before AI-assisted work product is delivered.
5. Regulatory and bar requirements
Legal and accounting regulators in many jurisdictions are publishing guidance on AI use. The Solicitors Regulation Authority in England and Wales, bar associations across EU member states, and the American Bar Association have all issued or are developing guidance on professional obligations around AI.
The control: A policy framework that maps regulatory obligations to practical controls. This includes tracking which jurisdictions and regulatory bodies govern the firm’s AI obligations and updating controls as guidance evolves.
